Representations and Warranties

The term “Content” means all material that you submit to us. By completing the sign-up process you represent and warrant that:

(a) All samples used in your works are either your own original production, genuine copyright-free samples or are used with all applicable licenses and rights granted. Furthermore you must be able to provide proof that you have the consent of the copyright holder to use any and all samples upon request.

(b) You have full right and power to enter into and perform this agreement, and have secured all third party consents necessary to enter into this agreement.

(c) The Content does not and will not infringe on any third party’s copyright, patent, trademark, trade secret or other proprietary rights, rights of publicity or privacy, or moral rights.

(d) The Content does not and will not violate any law, statute, ordinance or regulation.

(e) The Content is not and will not be defamatory, trade libelous, pornographic or obscene.

(f) The Content does not and will not contain any viruses or other programming routines that detrimentally interfere with computer systems or data.

(g) All factual assertions that you have made and will make to us are true and complete. You agree to indemnify and hold us and our customers harmless from any and all damages and costs, including reasonable attorney’s fees, arising out of or related to your breach of the representations and warranties described in this section. You agree to execute and deliver documents to us, upon our reasonable request, that evidence or effectuate our rights under this agreement.

User Data

Members of the Want-Signed.com website have the sole responsibility and liability for the data stored on the Want-Signed.com servers. We encourage all members to archive and regularly backup their files; User bears full responsibility for archiving their data and sole liability for any lost or irrecoverable data. Want-Signed.com can not and will not be held liable for lost data. Users agree to maintain their data in compliance with their legal obligations.

Copyright and Trademark Infringement Policy

Want-Signed.com is not a music distributer but rather a web hosting service provider. The musicians and dj’s who use the Want-Signed.com website have represented that they have full rights to submit content to our site. While Want-Signed.com is not in a legal position to determine who has the prevailing claim to use any particular content or name posted to the web site, we are 100% compliant with DMCA policies and procedures. If you are a copyright holder who believes their copyright is being infringed upon, and contacting the member directly has not resulted in satisfactory results, please notify us immediately. When notified of such abuse, Want-Signed.com will immediately disable access to disputed material.

Artist Pages

All artist pages on the Want-Signed.com website are intended for the use of individual artists or bands. The use of a Want-Signed.com artist page to host multiple artists without the express permission will result in suspension of said account and possible termination. If you operate a record label or are part of a dj collective you may inquire about becoming one of our record label affiliates. Also, though the goal of our site is to reward the top selling artists with record label deals and releases, they still must reach the minumum amount of sales as required by our affiliated labels. In no way does being a “Top Seller” on the site guaruntee a record deal or professional release.

Also if the Want-Signed.com website were to cease to exist, all obligations to our users in regards to membership durations whether Lifetime or otherwise would terminate affective the last day of operation.

Liability Waiver

By agreeing to and accepting the above Terms of Service you hereby release Want-Signed.com, it’s Partners, Affiliates, Investors, and any third party business that has dealings with us from any damages or liabilities that may arise from use of this Web site. You understand that our site presents no warranties or promises of any sort other than those presented in our Terms of Service. Want-Signed.com reserves the right to refuse service to any person at anytime depending on our sole discretion.

Modification of Terms and Conditions

Disputes

If there is any dispute about or involving the Want-Signed.com Services, you agree that the dispute shall be governed by the laws of the State of Pennsylvania, USA without regard to conflict of law provisions and you agree to exclusive personal jurisdiction and venue in the State and Federal courts of the United States located in the State of Pennsyvania, City of Downingtown.
